Terms of Service

1. Acceptance of Terms
By accessing or using CherishVow (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms from time to time; continued use after changes means you accept the revised terms.
2. Eligibility and Accounts
You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for maintaining the security of your account and for all activity that occurs under it. We may suspend or terminate accounts that violate these terms or that we believe present a security risk.
3. Service Description
CherishVow generates AI-powered wedding portraits from reference photos you upload. You describe your desired scene, and our system matches it to a scene from our internal reference catalog. Generated portraits are artistic renderings produced by AI models, not photographs of real events. Output quality may vary, and occasional artifacts or unexpected results are possible.
4. No Free Trial
CherishVow does not offer a free trial or free preview. Each generation round is paid upfront before any portraits are generated.
5. Payment, Rounds, and Refunds
A paid generation round costs $10 and produces five final upscaled portraits in 6K resolution, delivered to your gallery. Multi-round packs are available at a discount (3 rounds for $27 or 6 rounds for $51), and rounds purchased in a pack never expire. Payments are processed through Stripe. You are responsible for any taxes or fees imposed by your jurisdiction.
Each paid round includes one free redo of any single portrait from that round. A redo regenerates the selected portrait and is subject to the same scene and prompt constraints as the original round.
Because portraits are custom-generated and delivered instantly, we generally do not offer refunds. If you experience a technical failure or receive no usable output due to an error on our side, contact us and we will review your case in good faith.
6. Delivery and Expiry
Generated portraits are made available through your gallery. Download links remain active for 7 days from the time the round is completed. You are responsible for downloading and storing your portraits before the links expire. We may delete stored files after the 7-day period.
7. Your Content and License to Us
You retain ownership of the photos and descriptions you upload. By uploading content, you grant CherishVow a limited, non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and process that content solely to operate, improve, and support the Service. We do not use your uploads to train third-party AI models, and we do not use your generated portraits for advertising without your explicit consent.
8. Rights in Generated Portraits
Subject to your compliance with these terms, CherishVow assigns to you all rights, title, and interest we may hold in the portraits generated specifically for you. You may use the portraits for personal, non-commercial purposes such as printing, sharing with friends and family, and displaying in private settings. Commercial use, resale, or distribution of portraits as stock or generated-content merchandise is prohibited unless you obtain our prior written consent.
9. Portrait Rights and Consent
By uploading photos, you confirm that you own or have the necessary rights to those photos and that you have obtained consent from every identifiable person depicted. You may not upload photos of minors without verifiable parental or guardian consent. You are solely responsible for any claim arising from a lack of consent or rights.
10. Acceptable Use
You agree not to use the Service to upload or generate content that is unlawful, defamatory, harassing, obscene, sexually explicit, hateful, or that infringes any third-party right. You may not attempt to disrupt, reverse-engineer, scrape, or overload the Service, nor use generated portraits to deceive others about their origin. We may remove content and suspend or terminate accounts for violations.
11. Privacy
Your privacy matters. Our Privacy Policy explains how we collect, use, store, and protect your personal data, including face embeddings and uploaded photos.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these terms, misuse the Service, or if we discontinue the Service. Upon termination, your right to use the Service ends, but provisions related to intellectual property, liability, indemnification, and dispute resolution survive.
13. Disclaimers
The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not guarantee that outputs will match your expectations, be error-free, or suitable for any particular purpose. CherishVow is currently offered as an MVP beta service, and availability or features may change without notice.
14. Limitation of Liability
To the maximum extent permitted by law, CherishVow and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim arising out of or relating to the Service is limited to the amount you paid for the specific generation round giving rise to the claim.
15. Indemnification
You agree to indemnify and hold harmless CherishVow and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising out of your use of the Service, your content, your violation of these terms, or your violation of any third-party right.
16. Governing Law and Dispute Resolution
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising from these terms or the Service will be resolved exclusively in the state or federal courts located in Delaware. You waive any objection to jurisdiction or venue in those courts.
17. Changes to These Terms
We may modify these terms at any time. If we make material changes, we will post the updated terms and update the “Last updated” date. Your continued use of the Service after the changes become effective constitutes acceptance of the revised terms.
